Thanks in part to the introduction of the new matrimonial property regime, it is no longer customary to total the entire assets, but partners will retain their own private assets. If one partner invests -from his private assets- in the joint assets or in the partner's property, a right to compensation automatically arises. This applies to all relationships (cohabitants, registered partners, married couples)

In practice, agreements are often not made about how the invested (private) money will be divided if the marriage unexpectedly ends by divorce. This can cause nasty surprises. The longer the marriage lasts, the more difficult it becomes to prove which assets belong to which of the spouses. In case of uncertainty, an estimate will have to be made. We therefore recommend that investments in assets of the joint household and partner be properly administered (annually). We can offer you - for example with the annual review of your annual account(s) and income tax returns - that the created compensation rights of the past year are mapped out as standard.
